1. Agreement to These Terms

These Terms of Service (“Terms”) govern your use of the website at https://iliumweb.com, the Hi5 mobile application (the “App”), and related products and communications from HATAI LLC d/b/a Ilium Web (“Ilium Web,” “we,” “us,” or “our”), including SMS / text messaging.

By accessing or using our website or App, creating an account, submitting a contact form, connecting third-party integrations, or opting in to receive SMS messages, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site, App, or related services, and do not opt in to SMS.

2. Our Services

Ilium Web provides web development and related digital services for landscaping businesses, including websites, lead capture, and optional SMS communications related to inquiries and our services. We also offer the Hi5 mobile app, which may include account access, business communications features (such as calling), and optional third-party integrations (for example, Meta / Facebook / Instagram). Descriptions on our website and in the App are informational and do not guarantee any particular result.

3. Hi5 Mobile App

The Hi5 App is made available for download through applicable app stores (such as the Apple App Store or Google Play) and may also be accessed via supported web or development builds. Your use of the App is subject to these Terms and any applicable app-store terms between you and the store operator. We are responsible for the App and these Terms; the store operators are not parties to these Terms and have no obligation to provide maintenance or support for the App.

You may need an account and valid credentials to use certain App features. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. Notify us promptly at the email below if you believe your account has been compromised.

Some App features require device permissions (for example, microphone access for phone calls) or push notifications. You can manage permissions in your device settings; declining permissions may limit related functionality.

If you connect third-party services (such as Meta accounts or Pages) to Hi5, you authorize us to access and use information from those services as needed to provide the integration, subject to our Privacy Policy and the third party’s terms. You can disconnect integrations in the App and request account or data deletion as described on our User Data Deletion page.

4. SMS / Text Messaging Terms (A2P 10DLC)

If you provide your mobile phone number and affirmatively opt in to SMS (for example, by checking the SMS consent box on our contact form), you consent to receive text messages from Ilium Web related to your inquiry and our services.

Program name: Ilium Web. Message types may include responses to your inquiry, follow-ups, scheduling or service-related updates, and other messages described at the time of opt-in.

Messaging frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

You can cancel the SMS service at any time. Just text STOP to the number from which you received messages. After you send STOP, we may send you a confirmation, and you will no longer receive SMS messages from us unless you opt in again.

Consent to receive SMS is not a condition of purchasing any goods or services. Submitting a contact form without opting in to SMS does not authorize us to send you marketing text messages.

5. Mobile Information and Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except as necessary to deliver the messaging service itself (for example, to our SMS / telecommunications providers) under confidentiality obligations, or where required by law.

6. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our website, App, or opt in to SMS. Our services are intended for businesses and adult individuals acting on behalf of a business.

7. Acceptable Use

You agree not to misuse our website, App, or messaging channels, including by submitting false information, attempting unauthorized access, interfering with operation, reverse engineering the App except as allowed by law, abusing calling or integration features, or using our services for unlawful purposes.

8. Intellectual Property

The website and App content, branding, software, and materials provided by Ilium Web are owned by HATAI LLC or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your internal business purposes. You may not copy, modify, distribute, sell, or sublicense our materials or the App without prior written permission, except as allowed by law.

9. Disclaimers

The website, App, and communications are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site, App, integrations, calling features, or SMS delivery will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, HATAI LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the website, App, integrations, or SMS communications. Our total liability for any claim arising out of these Terms will not exceed the greater of the amount you paid us (if any) in the twelve months before the claim or one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless HATAI LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website or App, your violation of these Terms, or your violation of any law or third-party right.

12. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of this page will be revised when changes are posted. Continued use of the website, App, or SMS program after an update constitutes acceptance of the revised Terms where permitted by law.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.
